If the Prior Notice is not filed or contains errors, the shipment will be refused entry at the port. For Ghanaian exporters shipping from Tema and Takoradi ports, understanding this requirement is essential to maintaining access to the US market.
What is FDA Prior Notice and why is it required?
Prior Notice was introduced under the Bioterrorism Act of 2002 as a food safety measure. It gives the FDA advance information about incoming food shipments to assess risk before arrival. The filing must be submitted through the FDA PNSI or ABI/ACE systems. For Ghanaian exporters, this means ensuring the manufacturing facility's FDA registration number, product code, and shipper details are accurate before each shipment.
Filing timelines by mode of transport
For sea freight, filings must be confirmed at least 8 hours before arrival. For air freight, 4 hours. Most Ghanaian food exports travel by sea from Tema port, so the 8-hour requirement applies. PNSI filings cannot be submitted more than 15 calendar days before the anticipated arrival date. Exporters must ensure the filing is completed before the vessel departs.
Required information in a Prior Notice filing
The filing must include the FDA product code, food name, estimated quantity, manufacturing facility name and FDA registration number, shipper details, importer details, port of entry, and arrival date. For Ghanaian cocoa and shea butter exports, correct FDA product classification is essential. Incorrect product codes are a leading cause of shipment holds at US ports.
Common Prior Notice mistakes by Ghanaian exporters
The most frequent error is using an expired FDA facility registration number. Registrations must be renewed biennially during October-December of even-numbered years. The second error is product description mismatches. The third is timing — filing too late or before confirming the actual arrival date. Ghanaian exporters should also ensure their Ghana FDA registration does not conflict with or substitute for US FDA registration, as these are entirely separate systems.
