MoCRA is a law passed by the US Congress in 2022 and in force since 2023. For the first time in over 80 years, the FDA now has broad authority over the cosmetics industry. Under this law, all companies that manufacture, pack, or distribute cosmetics in the US market must register their facilities and submit a product listing to the FDA.

Which Nigerian Companies Are Required to Register?

MoCRA registration obligations apply to any Nigerian company that: manufactures or packs cosmetics for export to the US, whose brand name appears on product labels sold in the US market, or that uses contract manufacturers in Nigeria and distributes in the US. Both direct manufacturers and brand owners who outsource production must comply.

Step-by-Step MoCRA Registration Process

Step 1: Identify all manufacturing facilities involved in your products. Step 2: Register each facility with the FDA via the Cosmetics Direct system. Step 3: Prepare the product listing with complete ingredients (INCI names), intended use, and label information. Step 4: Include the name and address of your US Agent in the registration file.

US Cosmetics Labelling Requirements for Nigerian Exporters

In addition to registration, cosmetics labels sold in the US must be in English, include a full ingredient list using INCI names, state the manufacturer's information, and comply with FDA marketing claims regulations. Products with medicinal properties (such as skin-lightening or anti-acne claims) may be subject to additional OTC drug regulations under US law.

Nigeria's rich natural resources support a booming natural cosmetics segment with great US appeal: African black soap (ose dudu), shea butter from northern Nigeria, palm kernel oil, castor oil, moringa extract, baobab oil, and traditional herbal formulations.
