FDA Prior Notice and Import Compliance: What South African Exporters Must Know

Every food shipment to the USA requires an FDA Prior Notice filing. Here is what South African exporters of wine, rooibos tea, and dried fruits need to know.

Every food shipment entering the United States must be preceded by a Prior Notice filing with the FDA. There is no minimum shipment size exemption. South Africa exports a significant volume of food products to the US market, including wine, rooibos tea, dried fruits, macadamia nuts, canned fruits, and fresh produce. If the Prior Notice is not filed or contains errors, the shipment will be refused entry at the port, and the exporter bears the cost of re-export or destruction. For South African exporters shipping from Cape Town, Durban, or Port Elizabeth, understanding this requirement is critical to maintaining reliable access to the US market.

What is FDA Prior Notice and why is it required?

Prior Notice was introduced under the Bioterrorism Act of 2002 as a food safety defence measure. It gives the FDA advance information about incoming food shipments so the agency can assess risk before goods arrive. The filing must be submitted and confirmed through the FDA Prior Notice System Interface (PNSI) or the Automated Broker Interface (ABI/ACE). For South African exporters, this means verifying that the manufacturing facility's FDA registration number, product code, and shipper information are correct before every shipment.

Filing timelines by mode of transport

The FDA requires Prior Notice to be confirmed within specific windows before arrival. For sea freight — the primary mode for South African food exports — the filing must be confirmed at least 8 hours before arrival. For air freight, the window is 4 hours. For land transport, 2 hours. Filings through PNSI cannot be submitted more than 15 calendar days before the anticipated arrival date. South African exporters shipping via Cape Town or Durban ports must ensure the filing is completed before the vessel departs.

Required information in a Prior Notice filing

The filing must include the FDA product code, common or market name of the food, estimated quantity and packaging information, the manufacturing facility name and FDA registration number, shipper name and address, importer or consignee name and address, anticipated port of entry, and anticipated date of arrival. For processed foods, lot or batch numbers are also required. For South African wine exports, correct product classification under FDA codes is particularly important as wine falls under specific regulatory categories.

Common Prior Notice mistakes by South African exporters

The most frequent error is filing with an expired FDA facility registration number. FDA food facility registrations must be renewed biennially during the October-December window in even-numbered years. If the renewal is missed, every Prior Notice referencing that registration will be rejected. The second most common error is a mismatch between the product description and the actual shipment. The third issue is timing errors — filing too late or before confirming the actual arrival date.
