FDA Biennial Registration Renewal: What South African Manufacturers Need to Know

FDA facility registration is not a one-time filing. Food facilities, cosmetic facilities, and drug establishments all face renewal obligations, and missing them results in immediate compliance consequences. For South African food facilities, a lapsed registration means every shipment can be refused entry at a US port. No warnings, no grace period. Understanding the renewal timeline, process, and consequences is essential for every South African manufacturer selling into the United States.

Food facility biennial registration renewal

Under the FDA Food Safety Modernization Act, all food facility registrations must be renewed biennially during the period from October 1 to December 31 of each even-numbered year. The next renewal window is October 1 to December 31, 2026. If your facility does not renew within this window, the registration expires on January 1 of the following year. The renewal is submitted through FDA's FURLS system and requires confirming facility name, address, product categories, US Agent information, and emergency contact details.

Cosmetic facility renewal under MoCRA

Under MoCRA, cosmetic facility registrations must be renewed every two years. Unlike food registrations, cosmetic renewal dates are based on the initial registration date. South African cosmetic manufacturers exporting skincare, personal care, or beauty products to the US must track their individual renewal dates. Missing the renewal invalidates the registration and associated product listings.

Drug establishment annual registration

Drug establishments must update their registration annually between October 1 and December 31 — every year, not biennially. South African pharmaceutical companies manufacturing APIs or OTC drugs for the US market must comply with this annual obligation. The July 2026 proposed rule may require more foreign drug manufacturers to register, making annual renewal compliance even more critical.

Common renewal mistakes and how to avoid them

The most common mistake is simply forgetting. For South African manufacturers managing regulatory obligations across multiple export markets, the FDA renewal is easy to overlook. The second mistake is submitting with outdated information — a US Agent who is no longer available, a changed facility address, or product categories that no longer reflect actual production. The third mistake is waiting until the last week of December, when the FURLS system may slow down during peak renewal periods.
